Circuit Navigator Navi Tester Limited Warranty

NOTICE TO CONSUMER: This is a "Limited Warranty" as defined by the Magnuson-Moss Warranty Act. This document defines your rights regarding the warranty of your Circuit Navigator Navi tester and any additional products or accessories sold on the Circuit Navigator website.

COVERAGE PERIOD

ONE (1) YEAR FROM THE DATE OF PURCHASE

Persistent Engineering LLC ("we" or "our"), a New Jersey limited liability company and manufacturer of the Circuit Navigator product line, warrants to the original purchaser ("you" or "your") that the Circuit Navigator Navi tester ("Product") will be free from defects in material and workmanship, under normal use and service for a period of ONE (1) YEAR from the date of purchase. This warranty explicitly covers the rechargeable batteries contained within the Product.

WHAT THIS LIMITED WARRANTY COVERS

This limited warranty covers defects in materials and workmanship under normal use and service during the warranty period. "Normal use and service" means usage that conforms to the instructions in the user manual supplied with the Product and testing electrical circuits in accordance with the Product specifications.

EXCLUSIVE REMEDY

If a defect covered by this limited warranty occurs during the warranty period, Persistent Engineering LLC will, as your SOLE AND EXCLUSIVE REMEDY, replace the defective Product with a new or refurbished Product. Persistent Engineering LLC will not repair defective Products. Replacement is the only remedy available under this limited warranty.

HOW TO OBTAIN WARRANTY SERVICE

To obtain warranty service:

Contact Circuit Navigator customer service at 1-800-540-0702 (toll-free) or visit www.circuitnavigator.com/warranty to obtain a Warranty Return Authorization (WRA) number
Provide proof of purchase
Include your name, address, phone number, and a brief description of the problem with your Product
Ship the Product with the WRA number clearly marked on the outside of the package to the address provided by customer service

Persistent Engineering LLC will pay for shipping of the replacement Product to you within the United States. You are responsible for shipping the defective Product to Persistent Engineering LLC.

WHAT THIS LIMITED WARRANTY DOES NOT COVER

This limited warranty does not apply to:

Damage resulting from alterations, abuse, misuse, lack of reasonable maintenance, or normal wear and tear of the Product.
Replaceable (non-rechargeable) batteries.
Failure to turn product off when storing for long periods. Failure to recharge regularly.
Products with missing or altered serial numbers.
Cosmetic damage, including scratches, dents, and broken plastic that does not affect functionality.
Damage caused by use with non-Circuit Navigator products.
Damage caused by accident, misuse, abuse, liquid contact, fire, earthquake or other external causes.
Damage caused by operating the Product outside the permitted or intended uses described in the user manual.

LIMITATION OF LIABILITY

EXCEPT AS PROVIDED IN THIS LIMITED WARRANTY AND TO THE MAXIMUM EXTENT PERMITTED BY LAW, PERSISTENT ENGINEERING LLC IS NOT RESPONSIBLE FOR DIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES RESULTING FROM ANY BREACH OF WARRANTY OR CONDITION, OR UNDER ANY OTHER LEGAL THEORY.

Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you.

LIMITATION ON IMPLIED WARRANTIES

EXCEPT TO THE EXTENT PROHIBITED BY APPLICABLE LAW, ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE IS LIMITED IN DURATION TO THE DURATION OF THIS LIMITED WARRANTY.

Some states do not allow limitations on how long an implied warranty lasts, so the above limitation may not apply to you.

DISPUTE RESOLUTION

Any dispute arising under or related to this limited warranty shall be resolved through direct discussions and negotiation. If a dispute cannot be resolved through direct discussions, the parties agree to attempt to resolve the dispute through mediation administered by the American Arbitration Association under its Commercial Mediation Procedures before resorting to arbitration or litigation.

YOUR LEGAL RIGHTS

This limited warranty gives you specific legal rights, and you may also have other rights which vary from state to state. This limited warranty does not affect any additional rights you may have under state law regarding consumer warranties. Some states do not allow limitations on how long an implied warranty lasts or the exclusion or limitation of incidental or consequential damages, so the above limitations may not apply to you.

FOR NEW JERSEY RESIDENTS: The provisions of this limited warranty, including its limitations, are intended to apply to the fullest extent permitted by the laws of the State of New Jersey. If any portion of this warranty is held to be invalid, the remainder shall continue in full force and effect.
